This Privacy Policy (“Policy”) describes how BuildWize Inc. (“we,” “us,” or “our”) collects, uses, shares, and protects personal information when you visit our website at buildwize.ai, use our web and mobile applications, or otherwise interact with the BuildWize platform (collectively, the “Service”).

By using the Service, you agree to the collection and use of information as described in this Policy. If you do not agree, please do not use the Service.

If you are a California, Texas, or Nebraska resident, please see Section 12 for additional rights that apply to you.

1. Information We Collect

1.1 Information You Provide Directly

When you create an account or use the Service, you may provide:

  • Account and registration information, including name, business name, email address, phone number, and password
  • Project information, including project descriptions, addresses, client names, and milestone details
  • Payment information when paid plans are introduced (processed through a third-party payment processor; we do not store full payment card numbers)
  • Communications you send to us, including support requests, feedback, and correspondence

1.2 Information Generated Through Your Use of the Service

When you use the Service, we collect:

  • Video files and associated metadata (timestamps, file size, duration, device type) that you upload for AI processing
  • AI-generated outputs, including object tracking data, quality scores, safety flags, and milestone suggestions derived from your video content
  • Project activity logs, including actions taken within the platform and audit trails
  • Usage data, including pages visited, features used, time spent, and error logs
  • Device and browser information, including IP address, browser type, operating system, and device identifiers

1.3 Information About Third Parties in Your Content

When you upload video to the Service, that video may capture images, voices, or other information about third parties, including your workers, subcontractors, homeowners, and others present on your jobsite (“Third-Party Subjects”). You are responsible for ensuring you have all legally required consents to collect and submit this information.

Depending on applicable law and how their data is processed, Third-Party Subjects may have privacy rights with respect to their information. See Section 8 (Biometric Data) for additional information.

1.4 Information from Third-Party Services

If you connect the Service to third-party tools or platforms, we may receive information from those integrations consistent with your authorization and the third party’s terms.

2. How We Use Your Information

We use the information we collect to:

  • Create and manage your account and provide the Service
  • Process, analyze, and generate AI outputs from video and other content you upload
  • Generate project milestones, schedules, quality scores, safety alerts, and client progress reports
  • Send transactional communications, including account confirmations, feature updates, and service notices
  • Respond to your support requests and inquiries
  • Improve, test, and develop new features and capabilities of the Service
  • Train and improve our AI models using anonymized and de-identified data (see Section 5)
  • Detect, investigate, and prevent fraud, abuse, or violations of our Terms of Service
  • Comply with applicable legal obligations
  • Pursue our legitimate business interests, including understanding how the Service is used and evaluating our product roadmap

3. How We Share Your Information

We do not sell your personal information. We may share information in the following circumstances:

3.1 Service Providers and Subprocessors

We engage third-party vendors to help us operate the Service. These providers are authorized to use your information only as necessary to provide services to us and are contractually required to protect your data. Current key infrastructure providers include:

  • Supabase (database storage and authentication)
  • Vercel (application hosting)
  • Google Cloud (Document AI, Gemini AI processing)
  • Anthropic (AI assistant infrastructure)
  • Postmark (transactional and broadcast email delivery)

3.2 Aggregated Data

We may create aggregated, de-identified data derived from your use of the Service (“Aggregated Data”) that does not identify you, your business, your customers, or any individual. We retain all rights in Aggregated Data and may use it for any lawful internal business purpose, including improving the Service, conducting research, and generating industry benchmarks. We do not sell or license Aggregated Data to third parties.

3.3 Business Transfers

If we are involved in a merger, acquisition, financing, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will provide notice before your personal information is transferred and becomes subject to a different privacy policy.

3.4 Legal Compliance and Protection

We may disclose information when required by law, court order, or governmental authority, or when we reasonably believe disclosure is necessary to: (a) comply with a legal obligation; (b) protect and defend our rights or property; (c) prevent or investigate suspected wrongdoing in connection with the Service; or (d) protect the personal safety of users or the public.

We will notify you of legal process seeking your data unless we are legally prohibited from doing so, and we will seek to narrow overly broad requests.

3.5 With Your Consent

We may share your information for other purposes with your explicit consent.

4. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to operate and improve the Service. These technologies include:

  • Strictly necessary cookies required for authentication, security, and core Service functionality
  • Analytics cookies that help us understand how visitors interact with our website and platform
  • Preference cookies that remember your settings and choices

You can control cookie preferences through your browser settings. Disabling certain cookies may affect the functionality of the Service. We do not currently use advertising or cross-site tracking cookies on our platform.

If you are a California resident, you may opt out of the sale or sharing of your personal information through cookies by broadcasting an opt-out preference signal such as Global Privacy Control (GPC) on supported browsers.

5. AI Processing and Model Training

BuildWize is fundamentally an AI-powered service. When you upload video or other content, our systems process that content using machine learning and computer vision models to generate the features described in our Terms of Service.

5.1 How We Use Your Data to Improve Our Models

We may use de-identified, anonymized data derived from your use of the Service to train, evaluate, and improve our AI models. This includes:

  • Anonymized video frames and object detection outputs used to improve computer vision accuracy
  • De-identified workflow sequences and timing data used to improve scheduling predictions
  • Aggregated quality and safety flag data used to improve scoring models

We will not use personally identifiable information, identifiable faces, or content that could be linked back to you or individuals in your videos for model training without your explicit written consent.

5.2 AI Output Accuracy

AI-generated outputs (quality scores, safety flags, scheduling recommendations, milestone suggestions) are probabilistic and may be inaccurate. They are intended to assist your judgment, not replace it. You are solely responsible for verifying AI outputs before making business, safety, or construction decisions based on them.

6. Data Retention

We retain your account information and project data for as long as your account is active, plus a reasonable period thereafter to allow you to retrieve your data following account closure. Specific retention periods:

  • Account information: retained for the duration of your account, plus 90 days after deletion
  • Video content and AI outputs: retained for the duration of your account or project, as configured in your account settings
  • Usage and log data: retained for up to 24 months for security and analytics purposes
  • Anonymized training data derived from your content: may be retained indefinitely in de-identified form

You may request deletion of your account and associated personal data at any time by contacting legal@buildwize.ai. We will process deletion requests within 45 days, subject to legal obligations that may require us to retain certain records.

7. Data Security

We implement and maintain reasonable administrative, technical, and physical security measures designed to protect your personal information against unauthorized access, disclosure, alteration, or destruction. Our security practices include:

  • Encryption of data in transit using TLS
  • Access controls limiting employee access to personal data on a need-to-know basis
  • Supabase Row Level Security (RLS) policies governing data access within the platform
  • Regular security review processes as part of our development lifecycle

No security system is completely impenetrable. If we become aware of a security breach affecting your personal data, we will notify you and relevant authorities as required by applicable law.

8. Biometric Data

Important Notice: The Service uses computer vision technology to analyze video content. This analysis may involve detecting, tracking, or processing images of faces, hands, and other body parts, which may constitute biometric identifiers or biometric information under applicable law.

We process such data only as directed by you through your use of the Service and only to provide the Service features you have requested (object tracking, quality scoring, safety monitoring). We do not build persistent biometric profiles of individuals without your direction and consent.

You are responsible for: (a) providing required notices to individuals appearing in video you upload; (b) obtaining written consents where required by law, including under BIPA (Illinois), CUBI (Texas), and similar state laws; and (c) maintaining and following a written biometric data retention and destruction schedule consistent with applicable legal requirements.

If you receive a request from an individual to access or delete their biometric data captured in your video uploads, please contact us at legal@buildwize.ai so we can assist you in honoring that request.

9. Children’s Privacy

The Service is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without parental consent, we will promptly delete that information. If you believe we may have collected information from a child under 13, please contact us at legal@buildwize.ai.

10. International Data Transfers

The Service is operated in the United States. If you access the Service from outside the United States, your information may be transferred to and processed in the United States, where privacy laws may differ from those in your jurisdiction.

11. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will provide at least 30 days’ advance notice via email to the address on your account or by prominent notice within the Service. The updated Policy will be posted at buildwize.ai/privacy with a revised effective date.

Your continued use of the Service after the updated Policy takes effect constitutes your acceptance of the changes.

12. State-Specific Privacy Rights

12.1 California Residents (CCPA / CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

  • Right to Know: You may request information about the categories and specific pieces of personal information we have collected about you, the sources of that information, and the purposes for which it was used.
  • Right to Delete: You may request deletion of personal information we have collected about you, subject to certain exceptions.
  • Right to Correct: You may request correction of inaccurate personal information we hold about you.
  • Right to Opt Out of Sale/Sharing: You may direct us not to sell or share your personal information. To exercise this right, contact us at legal@buildwize.ai or broadcast a Global Privacy Control (GPC) signal on your browser.
  • Right to Limit Use of Sensitive Personal Information: You may request that we limit use of certain sensitive personal information to purposes necessary to provide the Service.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights.

To exercise your California rights, contact us at legal@buildwize.ai. We will respond to verified requests within 45 days. We may need to verify your identity before processing your request.

12.2 Texas and Nebraska Residents

Residents of Texas and Nebraska have similar rights to those described above for California residents, including rights to access, delete, correct, and opt out of the sale of personal information. To exercise these rights, contact us at legal@buildwize.ai.

12.3 Other State Residents

Similar privacy rights may apply to residents of Virginia, Colorado, Connecticut, Montana, Oregon, Florida, and other states that have enacted comprehensive consumer privacy legislation.
